By accessing the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as any additional terms and policies referenced herein. These Terms and Conditions apply to all visitors, users, and others who access or use the Website.

2.1. You agree to use the Website only for lawful purposes and in a manner consistent with all applicable laws and regulations.

2.2. You must not use the Website in any way that causes, or may cause, damage to the Website or impairment of the availability or accessibility of the Website, or in any way which is unlawful, illegal, fraudulent, or harmful.

**4. Privacy Policy**

**5. Real Estate Photography Terms of Service**

5.1. We offer professional real estate photography services, including property photo shoots, virtual tours, and image editing. The details of the Services provided will be outlined in specific agreements between us and our clients.

5.2. Requests for photography appointments should be submitted via our booking portal on our website, by phone at 954-554-9636, or by email to btahlikco@gmail.com with as much detail as possible. We will reply within 24 hours to verify the date, time, and location of the shoot. Next day orders are difficult to schedule, cannot be guaranteed, and are subject to an additional charge. Once both parties have acknowledged the date and time of the appointment, the appointment will be considered “booked”.

5.3. The Client is responsible for the presence of an authorized representative at the shoot to approve the Photographer’s interpretation of the project. If a Client or Brokerage representative is not present, the Photographer’s interpretation shall be deemed acceptable.

5.4. Once the images have been processed, the photographer will upload them to our Spiro portal for easy access and download.

5.5. If cancellation or rescheduling is necessary, please do so with a minimum of 24-hour notice. Any shoot canceled within 24 hours of a booked appointment is subject to a Cancellation Fee of $77.

**6. Limitation of Liability**

6.1. In no event shall Brian Tahlik Photography, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website.

**7. Indemnity**

7.1. You agree to indemnify and hold harmless Brian Tahlik Photography, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including legal fees and costs, arising out of or in any way connected with your use of the Website or violation of these Terms and Conditions.

8.1. Brian Tahlik Photography reserves the right to modify, amend, or replace these Terms and Conditions at any time. It is your responsibility to review these Terms and Conditions periodically for changes.
